1. Use of Services
QuickSMS.lk provides SMS gateway services that allow users to send and receive messages through our platform. By using our services, you agree to:
- Provide accurate and up-to-date information during the registration process.
- Use our services only for lawful purposes and in compliance with all applicable laws and regulations.
- Ensure that the content of your messages is appropriate, non-offensive, and respects the privacy of recipients.
2. Restrictions on Use
You are prohibited from using QuickSMS.lk to:
- Send spam, unsolicited bulk messages, or promotional messages without proper consent from recipients.
- Distribute harmful, abusive, or illegal content, including but not limited to obscene, defamatory, threatening, or fraudulent messages.
- Engage in activities that may interfere with the functioning of our platform or violate the rights of others.
3. Anti-Spam Policy
QuickSMS.lk strictly prohibits the sending of spam messages. Spam is defined as any message sent to a recipient without their prior consent or in violation of relevant laws and regulations, including the Telecommunications Regulatory Commission of Sri Lanka (TRCSL) guidelines.
- Violation of this policy may result in the suspension or termination of your account without notice and forfeiture of any remaining credits.
- We reserve the right to block messages flagged as spam or containing prohibited content.
4. Account Responsibilities
As a user of QuickSMS.lk, you are responsible for:
- Maintaining the confidentiality of your account credentials (username, password, API keys).
- All activities conducted under your account.
- Ensuring that messages sent through your account comply with our terms and applicable laws.
5. Payment, Top-Up, and Pricing
Our SMS services are offered on a pay-as-you-go basis, with rates and pricing clearly outlined on our pricing page.
- Top-Up Payments: Payments must be made in advance before sending messages, with a minimum top-up amount of Rs. 1,500.
- Non-Refundable: All top-up payments are non-refundable under any circumstances, even if the balance is not fully used.
- Pricing Tiers: We offer flexible pricing based on the amount of your top-up. Any changes in pricing will be communicated in advance.
6. Sender ID Policy
Each account comes with one free Sender ID. Additional Sender IDs can be purchased for Rs. 500 per year. The use of Sender IDs must comply with local regulations and cannot be used to impersonate or mislead recipients.
7. Delivery of Messages
QuickSMS.lk aims to ensure reliable and prompt message delivery; however, we do not guarantee that every message will be delivered due to factors beyond our control, such as network issues, recipient availability, or incorrect contact information. Delivery reports will be provided, but we are not responsible for undelivered or delayed messages.
8. Data Privacy and Security
We respect your privacy and take necessary measures to secure your data. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal information.
9. Limitation of Liability
QuickSMS.lk will not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, including but not limited to lost profits, loss of data, or interruption of business.
10. Termination
We reserve the right to terminate or suspend your account at any time, with or without cause, including but not limited to violations of these Terms and Conditions. Any unused credits will be forfeited in the event of termination due to misconduct or spam violations.
11. Governing Law
These Terms and Conditions are governed by the laws of Sri Lanka. Any disputes arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
12. Modifications to Terms
QuickSMS.lk reserves the right to modify or update these Terms and Conditions at any time. Changes will be communicated through our website, and your continued use of our services after such updates will signify your acceptance of the revised terms.
